Introduction: The sole proprietorship under the name “SAVVAS DROSOS”, based in Pothia, Island of Kalymnos, Postal Code 85200, with email address info@myoikia.com and VAT number 148212873 (G.E.MI. no. 150878420000), (hereinafter the “Company”), has the exclusive management of the website myoikia.com (hereinafter the “Website”). The Website provides an online platform for the presentation and promotion of real estate properties for sale or lease, offering information to all visitors/users (hereinafter the “User” or the “Users”) regarding available properties and related services. These terms of use, together with the attached privacy policy and cookie policy, constitute the legally binding agreement between the User and the Company regarding the use of the Website and the services provided through it.

Unreserved Acceptance of Terms: By accessing, browsing and/or using the Website, the User declares that they fully and unreservedly accept all these terms of use. If any User does not agree with the terms, they must not use the Website, must immediately discontinue browsing, and refrain from any further use of the Company’s services through the Website. Continued use of the Website implies that the User has read, understood, and fully accepted these terms and is bound by them on each new visit. Browsing and using the Website by the User also constitutes a statement that the User is over 18 years of age and that all information they provide is true, with the User being responsible for its accuracy. If the User uses the Website on behalf of a legal entity, they declare and guarantee that they have the authority to bind the legal entity and act on its behalf.

Right to Modify Terms: The Company reserves the right, at its discretion, to unilaterally and at any time amend these terms of use without prior notice. Any modification will become effective immediately upon being posted on the Website. Users are advised to regularly check the terms of use. Use of the Website after any modification of the terms constitutes acceptance by the User of the new modified terms. In the event that the User does not agree with the modified terms, they must discontinue the use of the Website and the Company’s services.

Purpose and Services of the Website: The Website is provided by the Company as an information and mediation platform in the real estate market. In particular, through the Website, properties offered for sale and/or lease by owners/clients are presented, and prospective buyers or tenants are given the opportunity to be informed about these properties. The Company may provide promotion and brokerage services, acting as an intermediary between owners (sellers/lessors) and prospective buyers/tenants, with the aim of concluding real estate sales or lease contracts. It is noted that the role of the Company, when acting as an intermediary, consists in facilitating contact between the parties and providing support services (such as listing the property through ads, collecting supporting documents, consulting, etc.), and under no circumstances is the Company the buyer, seller, lessor, or lessee of the properties themselves. Any contract of sale or lease of a property shall be concluded exclusively between the involved parties (owner and buyer/tenant), with the Company not being a contracting party but merely an intermediary.

User Account: Certain functions of the Website (e.g., property ad submission, creation of favorites list, access to full contact details) may require the User to create a personal account. Upon registration, the User is required to provide true, accurate, and complete information and to update it in case of changes. The User is solely responsible for maintaining the confidentiality of their password and the security of their account. Any action performed through the account is presumed to be made by the User. The Company bears no responsibility for any damage or issue arising from unauthorized use of the account, provided there is no prior fault on the part of the Company. In the event of a suspected security breach or unauthorized use, the User must immediately notify the Company.

User Obligations and Conduct: Users agree to use the Website legally and in accordance with these terms. Indicatively and not exhaustively, the User agrees that during use of the Website they shall not:

  • Violate laws or regulations: Any act contrary to applicable Greek and European legislation or infringing third-party rights (e.g., intellectual property rights, personal data, personality, etc.).
  • Engage in misleading or abusive behavior: Posting or transmitting false, inaccurate or misleading content, offensive, defamatory, obscene or illegal material. Posting ads or content about properties that do not exist or for which the User does not have the proper authorization/instruction for promotion is prohibited.
  • Unauthorized access and interference: Attempting to interfere with or disrupt the operation of the Website or its servers, through the spread of malicious software, viruses or other harmful code. Attempting unauthorized access to any part of the Website, other users’ accounts, computer systems or networks connected to the Website is prohibited.
  • Data collection: Using automated means (bots, crawlers, etc.) to collect information or extract data from the Website without the Company’s written permission. Mass collection of listings or user data (scraping) as well as the use of the Website for sending unsolicited communications (spam) is prohibited.
  • Interference with other users’ experience: The User shall not take actions that could burden or harm the experience of other users, such as continuous message sending, posting repetitive content, or attempting to deceive other members of the platform.

Failure to comply with the above obligations may lead, at the Company’s discretion, to temporary or permanent suspension of the User’s access to the Website, deletion of any account/content, as well as any lawful measure for the protection of the Company’s legal interests.

Intellectual and Industrial Property Rights: All content of the Website (including but not limited to: texts, photos, images, graphics, logos, distinctive signs, trademarks, listing database, software and all types of files) is protected under Greek and European intellectual property, trademark and industrial property law. The Company and/or its licensors (such as partners, advertisers, software providers) retain the intellectual property rights over this content. Any reproduction, copying, storage, modification, transfer, distribution, transmission, republication, sale, translation or general use of the Website’s content for commercial purposes is strictly prohibited without the prior written permission of the Company. Only personal, non-commercial use and temporary storage of content (e.g., saving a listing for personal reference) is allowed, provided that any copyright or ownership notices are not altered or removed.

A User who uploads content to the Website (e.g., property photos and descriptions in listings) retains the intellectual property rights to the content provided but grants the Company a non-exclusive, worldwide, royalty-free license to use, store, reproduce, display, translate and distribute such content through the Website for the purpose of property promotion and provision of related services. The User guarantees that they have the right to grant this content and that it does not infringe third-party rights (e.g., personal data of individuals in photos, third-party intellectual property rights in images/texts, etc.). The Company reserves the right to remove any content posted by the User if it deems that it violates the law or these terms or to request the User to modify/correct the provided information.

Limitation of Company Liability: The information and content available through the Website are provided “as is.” Although the Company makes efforts to ensure the accuracy and update of the information (e.g., property availability and features, prices, descriptions), it cannot guarantee that all information is always complete, accurate and current. Each User/visitor must evaluate the provided information and act on their own judgment and responsibility, verifying any critical details before making decisions. The Company bears no responsibility for any direct or indirect damages, loss of income or profits, loss of opportunities, loss of data, or any kind of damage to the User or third parties arising from the use of the Website, inability to use it, delays or interruptions in operation, inaccuracies or omissions in content, or any errors/defects in the software. Any information contained on the Website is provided strictly for informational purposes and in no case constitutes advice, proposal or encouragement to act (e.g., does not constitute investment or legal/tax advice) – the User must consult appropriate professionals before making any decision. Furthermore, the Company does not guarantee uninterrupted availability or error-free operation of the Website, nor that the server or servers through which the Website is made available are free of “viruses” or other harmful elements. The User is responsible for taking all necessary measures to protect their device and systems from viruses, malware or other threats. The Company recommends that Users use protection software (e.g., antivirus) and scan any files received from the Website before installing or using them.

The Company bears no responsibility for the content of third-party websites that may be linked through the Website via hyperlinks. The provision of such links is solely for the User’s convenience. Access to third-party websites is at the User’s own risk and such websites are subject to their own terms of use and policies, for which the Company bears no responsibility or control. Similarly, the Company is not responsible for communications or transactions of the User with third-party advertisers or service providers that may be displayed on the Website – any such transaction is carried out exclusively between the User and the respective third party without any responsibility of the Company.

Right of Withdrawal: If the User enters into a contract with the Company for the provision of brokerage or property promotion services remotely (e.g., electronically, through the Website or via email/phone, without physical presence), as a consumer they retain the legal right to withdraw from this contract within 14 calendar days from the date of conclusion. Withdrawal is exercised by sending a clear statement (e.g., via email to the Company’s address) before the deadline expires. In the case of a valid withdrawal, the Company will cease the provision of services and the User will not bear any financial charge, apart from any fees for services already provided upon the User’s request. It is noted that if the User has expressly agreed for the service provision to begin before the 14-day period expires and acknowledges that they lose the right of withdrawal (e.g., if they request immediate promotion of their property), then the Company may complete the service and the User will not be able to exercise the right of withdrawal.

Applicable Law and Jurisdiction: These terms of use, as well as the use of the Website by the User, are governed by Greek law. Any dispute arising from or in connection with the interpretation, performance, or application of these terms shall be resolved by the competent courts of Greece. If no amicable resolution is reached, the competent courts of the jurisdiction of the Dodecanese (indicatively, the courts of Kalymnos or Rhodes) shall have jurisdiction, unless otherwise provided by law.

  • Data Categories: For property owners, this may include full name, contact info, ID/passport, VAT number, property documents (titles, zoning, energy certificates), photos, bank info. For buyers/tenants: contact details, preferences, financial info (e.g., need for a loan).
  • Recipients: Data may be shared with interested buyers/tenants, legal/technical advisors, banks (with consent), or third-party collaborators such as other agents, photographers, or listing platforms, under confidentiality and lawful processing agreements.
